These Online Terms and Conditions are a contract between you and SA CAR CARPETS CC (REGISTRATION NUMBER 97/1164/07 doing business as “ALMA SOUTH AFRICA”. Our physical address is Johannesburg South Africa. SA CAR CARPETS CC is referred to in these Online Terms and Conditions as “ALMA SOUTH AFRICA” . These Online Terms and Conditions apply when you use the “ALMA SOUTH AFRICA” website (“Website”) (located at www.almasa.co.za), when you buy any products through the “ALMA SOUTH AFRICA”  website, and when you use of any these products or “ALMA SOUTH AFRICA” services. By accessing the “ALMA SOUTH AFRICA” website you agree to these Online Terms and Conditions. If you do not agree to these Online Terms and Conditions you must not use the “ALMA SOUTH AFRICA” website.

Disclaimer and limitation of liability

“ALMA SOUTH AFRICA” is not liable for any indirect, consequential, special, incidental or punitive damages, including lost profits, even if “ALMA SOUTH AFRICA” has been advised of the possibility of such damages.

“ALMA SOUTH AFRICA”  is not liable for any damages, liability or harm caused by any failure or defect in any product advertised and purchased on the Website, howsoever arising. To the fullest extent permitted by law, “ALMA SOUTH AFRICA” excludes all liability in regard to the purchase, use and dissemination of any products on the Website.

These Online Terms and Conditions do not affect your statutory rights, including your rights under any applicable consumer laws, which cannot be altered by contract.

Content on the “ALMA SOUTH AFRICA” Website
All content on the Website, such as information, text, pictures, photographs, graphics, interfaces, and the design, structure and arrangement of the content, belongs to “ALMA SOUTH AFRICA”  or is licensed to “ALMA SOUTH AFRICA”  and is protected by law. Termination
If you do not comply with these Online Terms and Conditions when accessing or otherwise using the Website, “ALMA SOUTH AFRICA”  has the right to suspend your access to the Website temporarily or permanently without notice to you. “ALMA SOUTH AFRICA” may also stop operating the Website entirely.

Sales in and outside South Africa
“ALMA SOUTH AFRICA” will accept orders for delivery addresses in South Africa, provided such is a valid address recognised by our couriers. Any international deliveries shall be arranged on an ad-hoc basis, please contact name@name.co.za for further information Products sold through the Website are intended for use only in South Africa.

Age
By using the “ALMA SOUTH AFRICA”  website you are representing that you are above the age of 18 years or, if you are below the age of 18 years, that you have the permission of your parent or guardian to use the “ALMA SOUTH AFRICA” website and to buy products through the Website.

Billing and personal information
In order to buy goods and services through the Website, you will need to register an online customer account with “ALMA SOUTH AFRICA” . For this purpose you will need to provide “ALMA SOUTH AFRICA”  with certain personal information and billing information that will enable “ALMA SOUTH AFRICA”  to charge you for your purchases (such as your credit or debit card details). When you set up your online customer account you will choose a username and password. You will have to use these details to log-in to your account. You are responsible for keeping these details confidential. You must notify “ALMA SOUTH AFRICA” immediately if there is any unauthorized use of or access to your online customer account.  “ALMA SOUTH AFRICA”  will not be responsible for any unauthorized use of your username and password or for any losses that you suffer as a result and you will be responsible for any purchases made using your online customer account, where you have failed to keep your username and password secure and confidential. You may be held responsible for any losses suffered by “ALMA SOUTH AFRICA” or any other user of the Website as a result of your failure to keep your username and password secure and confidential.

Order process
When you place an order for any product on the Website, your order will be subject to product availability. If, after you place your order, there is insufficient stock to fulfill your order, “ALMA SOUTH AFRICA”  has the right to cancel your order or any part of your order and refund the purchase price. “ALMA SOUTH AFRICA” will refund the purchase price based on the original payment method (i.e. to your credit or debit card) or issue store credit, based on your choice, and will notify you, as soon as possible, that there is insufficient stock to fulfill your order. If “ALMA SOUTH AFRICA” are unable to supply each and every item ordered or in the quantities ordered, you nevertheless agree to accept delivery and make payment for the items that are delivered to you. “ALMA SOUTH AFRICA”  reserves the right to limit the quantity of any item offered for sale on its Website. “ALMA SOUTH AFRICA” also reserves the right, in its sole discretion, to remove any product from its Website at any time.

Before the transaction is completed, you will have the opportunity to review your order that has been placed through the Website. You can withdraw your order at any time before finally placing it. If you discover that you have made a mistake with your order after you have submitted it to the Website, please contact almasa.co.za immediately. However, we cannot guarantee that we will be able to amend your order in accordance with your instruction.

Once your order has been placed online, you will receive an email confirmation of your order from Company Name. Your offer to purchase products through “ALMA SOUTH AFRICA”  website will be deemed to be accepted once you have received this confirmation of your order.

Payment processing
All transmissions of billing information and data through the Website are encrypted and “ALMA SOUTH AFRICA” takes extensive steps to ensure that any transaction through the “ALMA SOUTH AFRICA” website is secure. All credit card transactions are secure socket layers encrypted. “ALMA SOUTH AFRICA”  registration documents and the website’s registered domain name are checked and verified by  MYGATE. . “ALMA SOUTH AFRICA”  Returns Policy can be accessed at www.amasa.co.za/returns-policy and is incorporated by reference into these Online Terms and Conditions. If there is any conflict between these Online Terms and Conditions and the “ALMA SOUTH AFRICA”  Returns Policy, these Online Terms and Conditions will apply in respect of health and other products sold through the Website.

Pricing changes
“ALMA SOUTH AFRICA” reserves the right at any time and without any advance notice to make changes to the prices of goods that are sold through the Website and to correct any pricing errors that may inadvertently occur. “ALMA SOUTH AFRICA” is not liable for any typographical errors that may occur.

Delivery of the product/s
Products purchased through the Website will be delivered to a physical address of your choice, which must be selected during the online ordering process. Deliveries will be performed by a courier company engaged by “ALMA SOUTH AFRICA” . No deliveries will be made on weekends and public holidays. You may be required to sign for delivery and to provide a valid form of identification when your order is delivered. You agree to inspect the products for any obvious faults, defects or damages before you sign for delivery.

If you are not available to take delivery, we may leave your delivery with an adult at the delivery address. If delivery is delayed through your unreasonable refusal to accept delivery, then “ALMA SOUTH AFRICA” may no longer make the products available for delivery by cancelling your order and refunding to you the money already paid to “ALMA SOUTH AFRICA”  less “ALMA SOUTH AFRICA”  reasonable administration charges (including the costs for attempting to deliver and then returning the products).

“ALMA SOUTH AFRICA” is not liable for any incorrect order or delivery where you make an error in the information that you provided to “ALMA SOUTH AFRICA” e.g. if you provide the incorrect delivery address or submit an incorrect order. If you do not provide a valid physical address for delivery, “ALMA SOUTH AFRICA”  may cancel your order and refund the purchase price. It may also not be possible for us to deliver to some locations. If this is the case, we will inform you using the contact details that you provide to us when you place your order, and will arrange for cancellation of the order or delivery to an alternative delivery address.

Products will be delivered as per the stated delivery times on the Website. It may happen that items in your cart we purchased from more than one of our suppliers. In this case, the delivery time will be as per the item with the longest estimated delivery time, or products may be delivered separately.

We take all reasonable steps to ensure that your ordered products are delivered within the time frames described on the Website. You acknowledge that the delivery of your order may be impacted by events beyond “ALMA SOUTH AFRICA”  control such as adverse weather conditions or industrial action. “ALMA SOUTH AFRICA” is not liable for late deliveries of products purchased through the “ALMA SOUTH AFRICA” website.  “ALMA SOUTH AFRICA”  is also not liable for any losses, damages, charges or expenses that arise out of late delivery. “ALMA SOUTH AFRICA” will, however, try to ensure a smooth delivery process.

“ALMA SOUTH AFRICA”  delivers the products in standard packaging. You understand and accept that the packaging of the products offered on “ALMA SOUTH AFRICA”  website (e.g. bottles, containers, packets, etc.) may be different from the packaging of the product that is delivered to you. All risk in the products will pass to you upon delivery; from the time when the risk passes to you, “ALMA SOUTH AFRICA”  will not be liable for any loss or destruction of the products.

Promotional coupons and vouchers
From time to time, “ALMA SOUTH AFRICA” may release, at its sole discretion, promotional coupons that may be used on the Website, which will be sent to you by email. “ALMA SOUTH AFRICA”  accepts no liability for any errors in the email address of the voucher recipient. Promotional coupons can only be redeemed through purchases on the Website. Promotional coupons are only valid for a specified period, as stated on the promotional coupon, can only be redeemed against regular priced products on the “ALMA SOUTH AFRICA” website, and cannot be used in conjunction with any other promotional coupons. Certain products may also not be purchased with a promotional coupon. To the extent that you place an order for a product less than the value of the promotional coupon, no refund or residual credit will be returned to you. You also agree and accept that the credit of a promotional coupon does not accrue interest and does not have a cash value. If the credit of a promotional coupon is insufficient for a particular order that you have placed, you will be required to pay the remaining amount by credit card or debit card.

“ALMA SOUTH AFRICA”  will not be liable for any loss, theft or illegibility of any promotional coupon.

Users may also purchase gift vouchers for use of a third-party on the Website. Any such voucher shall be subject to that third-party’s registration on the Website as a user. To the extent that you place an order for a product less than the value of the voucher, no refund or residual credit will be returned to you. You also agree and accept that the credit of a voucher does not accrue interest and does not have a cash value. If the credit of a voucher is insufficient for a particular order that you have placed, you will be required to pay the remaining amount by credit card or debit card.

Other terms and conditions
Additional terms and conditions may apply to specific products that are made available through the Website and to other features that are made available on the Website such as competitions. Those additional terms and conditions form part of these Online Terms and Conditions and you agree that you are bound by them. If there is a conflict between these Online Terms and Conditions and any specific terms and conditions applicable to any particular product or service or feature of the Website, the specific terms and conditions will apply.

Changes to the contract
“ALMA SOUTH AFRICA” reserves the right to make changes to these Online Terms and Conditions at any time. If you are an existing customer, “ALMA SOUTH AFRICA” will notify you in advance (either by notice on the Website or otherwise) of any material changes that it intends to make to these Online Terms and Conditions before the changes come into effect. It is your responsibility to check these Online Terms and Conditions, from time to time, for any such amendments. If you do not wish to be bound by the amended contract, you should not continue to use the Website.

Interpreting the contract, governing law and dispute resolution
These Online Terms and Conditions are governed by the laws of South Africa, regardless of conflict of laws principles.

A court may find that some of the provisions of this contract are not enforceable. If this occurs, the remaining provisions of the contract will continue to apply. “ALMA SOUTH AFRICA”  will replace the affected provisions with new provisions that achieve the intended purpose but that are capable of being enforced in South Africa.

Record of your transaction
If you need to obtain a sales record of your transaction to buy products through the Website, you can contact “ALMA SOUTH AFRICA” within 30 days of the transaction. Alternatively, a full record of every sale and related transaction between you and “ALMA SOUTH AFRICA”  will be maintained on the “ALMA SOUTH AFRICA” website for a period of 6 months following the date of the purchase. You will be able to view and print these records of your transaction during this period, after which time, you will be responsible for retaining your own record of the relevant transaction.

Complaints and notices
We place great value on our customer satisfaction. Complaints and queries should be sent by email tosales@almasa.co.za and we will attempt to address your concerns as soon as reasonably possible and will contact you on receipt of any relevant enquiry or complaint. In the event of a complaint, it will help us if you can describe the object of your complaint as accurately as possible and, where applicable, send us copies of your order or the order number that we assign you. Should you not have received any reaction from us within five business days, please make further enquiries. In rare cases, your emails may have been caught up in our spam filters or not reach us, or correspondence that we send to you may otherwise not have reached you.

Any legal notices that you give “ALMA SOUTH AFRICA”  under this contract must be sent by registered post to POBOX 868 SOUTHDALE 2135 , with a copy to sales@almasa.co.za

 “ALMA SOUTH AFRICA” needs to give you any notice as provided for in this contract or provide additional information about the products and services supplied to you, “ALMA SOUTH AFRICA” will do so by sending you an email or posting a notice on the Website. You consent to “ALMA SOUTH AFRICA” providing you with notices or information in this way.

We will keep your personal information only for as long as is necessary to achieve the purpose for which the information was collected. For example, if you close your online customer account with “ALMA SOUTH AFRICA” , we will delete the information that we collected from you in order to administer your online product purchases. If you tell us that you do not wish to receive information about new products we will delete your contact details unless we require your details for another purpose.

Returns Policy
We do our best to make sure that all of our products on the Website come with a detailed description and images, and are of the highest possible quality, so that you can shop with confidence. If you are still not satisfied with the item you have received, you may return it within 14 days at your expense, for any reason, for a full refund. If the product is damaged, defective or does not match the order, we will collect and refund or replace it at no cost to you. Note that all returns are subject to the conditions below.
When you receive your order, it is IMPORTANT that you check to make sure everything is in good condition (i.e. not damaged or defective) and let us know right away if there is a problem with your order.

Damaged, defective or incorrect products
If the product you have received is damaged, defective, does not fit for its intended purpose or does not match the order, we will collect and refund or replace it free of charge, provided that

  • You notify us of the issue within 7 days of delivery, and the item is in intact (other than initial damage) and in its original packaging.

After 7 days, we will only accept returns for defective products if the defect can be shown to have existed before the product was delivered.
Please contact us to notify us of the issue, and we will arrange a replacement.

Returns for any other reason
You may return your product for a full store credit or cash refund if you do not want the product for any reason within 7 days of delivery, but will have to cover the cost of return postage yourself. Returns are eligible provided that

  • You notify us of the return within 7 days, the item is in its original packaging and is in a re-sellable condition,
  • The item is not on the list of ineligible products (see next section).

Please contact us to notify us of the return, and we will provide details of how you can send us the product, via either a courier pickup that we can arrange (at your cost), or via the Post Office.

Ineligible products
“ALMA SOUTH AFRICA” will not accept returns of any of the following products, except in the event of damage, defects or incorrect deliveries:

  • Items returned without original packaging or after 14 days opened cosmetics, fragrances, and other items for human consumption

Note that all products (including the above) can be exchanged or refunded if they are faulty, not fit for their intended purpose or do not match the sample or description.
Please DO NOT DISCARD ANY ITEMS unless you have been directed to do so by “ALMA SOUTH AFRICA” .
Returns will be refunded as store credit or as cash, paid back into the payment method that was used to pay for the order.
If you choose to return part of an order, you may no longer qualify for all special offers associated with your purchase. For example, if you received a free gift with purchase you may be required to return the gift in order to receive full credit for your return.
